Terms of Service
Perfectly Polite Dachshunds (PPD) Booking Terms and Conditions. GDPR and Social Media Policy. Cancellation and Refunds Terms.
Please ensure you have read and understood these Terms and Conditions before you make a booking. By placing a booking you are deemed to have read, understood and expressly accepted them.
Contract of Sale
Completion of the booking process and acceptance of our terms and conditions forms your contract with the Perfectly Polite Dachshunds.
Payment
Payment of the full course fees must be made in advance and are made at the time of placing a booking. It is not possible to attend a course unless payment has been received.
We accept payment by credit/debit card or by bacs.
Cancellation
You have a legal right to change your mind about proceeding with your course purchase under the Consumer Contracts Regulations 2013. All cancellations must be made by email to perfectlypolitedachshunds@outlook.com within 14 days of your booking being completed. If you have made a booking within 14 days of the course start date you waive your right to a ‘cooling off period.’
Attendance Courses, Virtual courses or 1-2-1 sessions in person or virtually
Cancellations of attendance courses or 1-2-1 sessions after the expiry of the 14 day period referred to above will be subject to the following fees:-

Cancellations within 0-7 days prior to the start date of the course will be charged the full course fee.

Cancellations within 8-14 days prior to the start date of the course will be charged 50% of the full course fee.

Cancellations beyond this may be subject to an admin fee in line with provider fees
Cancellation policy applies to all sessions on the Perfectly Polite Dachshunds website, whether paid for in full or installments.
Once a service has started no refunds will be provided.
Should PPD have to postpone a course or 1-2-1 for any reason, you will be offered an alternative date or credit note for a matching service available on the PPD website. All credit notes are valid for 6 months from the date of issue
By accepting these Terms and Conditions, you are expressly consenting to PPD commencing the provision of services under this contract by sending to you by email the necessary course notes to commence the correspondence course, which will affect your ability to change your mind and cancel your booking and obtain a refund.
Where the correspondence course starts, you do not have the right to change your mind, even if the cancellation period is still running.
If you cancel with the 14 day cooling off period and after we have commenced you will not be eligible for any refund, PPD will endeavour to transfer you onto another similar course at the corresponding week at their discretion. Additional fees may apply.
Delegate Substitution
All changes of delegate names must be requested 5 days prior to the start of the event by email to perfectlypolitedachshunds@outlook.com and the change of delegate must be agreed by PPD prior to attendance.
Transfer
Requests to transfer to an appropriate alternative course or date must be made by email to perfectlypolitedachshunds@outlook.com
Transfers can only be made onto courses that are currently listed on the PPD website.
A booking can only be transferred on one occasion. Requests for subsequent transfers will be treated as cancellations. Additional fee's may be required.
Webinars/Online courses
All materials are to be viewed by the purchasing customer only and must not be shared with a 3rd party unless express permission is first granted by The PPD
Course Content
PPD reserves the right to change the content, timing, date, venue or Instructor of the course in order to provide a high quality service or where it is necessary for reasons beyond our control. PPD reserves the right to cancel a course up to and including the date of the course and will strive to give as much notice of this as possible. Individuals booked onto a cancelled course will be given the option of a full refund or of rescheduling to a future course date. PPD will not be liable for any losses or expenses arising from amendments to the course or cancellations. Course materials are supplied only for your personal use.
Intellectual Property
PPD remains the owner of all intellectual property in course materials. No part of the materials may be copied, recorded or reproduced without our permission in writing.
Limitation of Liability
PPD will accept no responsibility for any losses, either direct or indirect, which you suffer in connection with the services provided under this contract.
Data Protection
Any personal information you give to us with be processed in accordance with the Data Protection Act 2018. We will use the information to process your booking, to provide the course and to inform you about similar courses which we provide, unless you tell us that you do not want to receive this information. Any personal data you provide may be held on computer files. All personal data will be handed appropriately in accordance with the provisions of General Data Protection Regulations.
Applicable Law and Jurisdiction
These terms and conditions are governed by and construed in accordance with English law and any dispute arising out of or in connection with them shall be settled by the English courts.
Online classes and virtual consultation disclaimer
Use of our online training course and virtual consultations carries with it risks that we cannot eliminate. These include the risk of person injury.
Rules
When participating you are doing so at your own risk
You must act responsibly and sensibly at all time
You must not participate if you are a child who is unaccompanied by and adult or under the influence of alcohol or non-prescription drugs.
You must follow any safety warning or instruction given to you by your dog trainer or contained in the course material please ask your trainer if you are unclear.
We are not qualified to express an opinion that you are fit to safely participate in the online training course. You must obtain professional or specialist advice from your doctor before participating or avoid any activities if you have any current health concerns, injuries or aches and pains.
Please use a suitable non slip flooring during training
In the absence of any negligence or other breach of duty by us, participation in the training course or consultation is entirely at your own risk.
Virtual training sessions will be recorded and these recordings retained for a minimum of 36 months, as requested by Protectivity insurance.
Disclaimer for personal injury or death (use of equipment)
You are responsible for using equipment in a reasonable condition that meets UK product safety standard and as directed in the training materials provided. You must behave sensibly, use the equipment as intended and follow any safety instruction so as not to hurt or injure yourself, your dog or others.
Disclaimer for loss or damage of property
In the absence of any negligence or other breach of duty by us, we are not responsible for any damage, destruction or loss of your property while using our training materials.
Disclaimer for dog behaviour
In the absence of any negligence or other breach of duty by us, we are not responsible for any loss or injury arising from an act or omission by you or your dog, This includes but is not limited to:

Circumstances where your dog attacks you as the owner, another person or another dog and;
Veterinary bills for any injury caused to your dog or a third parties dog as a result of using the training course.
Medical bills for any injury caused to you or a third parties as a result of using the training course.
GDPR and Photography Statement

When you visit our website, social media page and/or use our services, you trust us with your personal information. We take your privacy very seriously.
This privacy policy applies to all information collected through our websites, our Facebook applications and/or any related services, sales, marketing or events (we refer to them collectively in this privacy policy as the “Sites”).
We may keep personal information to contact you directly, this will not be shared deliberately with third parties unless at your request.
Payment information is not held by the company.
You may be contacted by the company to be advised of upcoming events, promotional materials relevant to the company or to receive updates on your progress.
Photography/Video use
Photographs and videos may be taken of group or 121 sessions.
Zoom sessions will be recorded and videos posted on the facebook groups may be within Zoom courses to provide examples, support or advice.
Pictures and videos may be used for educational and promotional purposes but will not identify you by name unless we expressly ask your permission in writing.
They may be forwarded to you for your own private use at your request.
Video sharing is one of the key components of the course and by agreeing to these terms and conditions you agree they can and may be shared with your course group and others.
They may be used for promotional or educational reasons at any time by Perfectly Polite Dachshunds.

Dynamic Dog Assessment Terms and Conditions

Duration of the agreement:
The Dynamic Dog Assessment programme is a four-week programme (“assessment period”) which is deemed to commence on the date that the Zoom/Teams appointment (90 mins) is completed.
Extension to this agreement is at the sole discretion of Sharon Alton and will only be granted in the case of exceptional circumstances.
Submission of video footage and photographic images:
After the Zoom/Teams appointment (90 mins) you will be provided with a filming guide. Providing in more detail the best way to capture your dog on film.
All video clips and photographic images must be submitted in accordance with the filming guide within 14 days of the start of the zoom appointment. Failure to do so may result in the assessment not being completed within the assessment period.
Extensions to the assessment period may be granted, but this is at the discretion of Sharon Alton and may incur further charges.

Quality of video footage and photographic images:
It is important that the images and video footage are of a sufficient high standard for them to be easily analysed by Sharon Alton. If a piece of footage or image is not up to this standard, you will be requested to re submit it. All Re-submissions should be made as soon as possible, but in any event within 72hrs unless in exceptional circumstances e.g. extreme weather conditions.
WhatsApp Submissions
You are requested to use WhatsApp to submit your photographs and videos to Sharon Alton. You should use this to submit your photos once you’ve taken them to avoid sending Sharon Alton everything all at once.
Should you have any questions about the assessment process, filming, or your dog during the assessment period – please use this channel to do so.
The client is advised that Perfectly Polite Dachshunds will only collect the personal information necessary for the completion of the assessment including preparation of the vet report and data required to carry out the proper completion of the assessment.
This includes:
Providing you with our services.
Providing you with information you may have requested and answering your queries.
Providing you with information we consider may be of interest to you in relation to you or your dog specifically.
Confidential Client Information includes:
The Dynamic Dog Practitioner/client relationship is founded on trust and, in normal circumstances, a DD Practitioner should not disclose to any third party any information about a client or their animal. This includes information given by the client, or revealed by a Veterinary Report.
The duty of confidentiality is important but it is not absolute and information can be disclosed in certain circumstances, for example where:
The client's consent has been given
Disclosure can be justified by animal welfare concerns or the wider public interest, or disclosure is required by law.
In addition to the duty of confidentiality, the personal data of clients must be handled in accordance with the General Data Protection Regulation (GDPR) (note that animal data falls outside the scope of the GDPR). Under the GDPR, the disclosure of personal data without consent is permitted where it is necessary for compliance with a legal obligation, or for the purpose of a legitimate interest. Accordingly, the GDPR is not a barrier to the reporting of concerns and suspicions to the appropriate authorities.
It is understood and agreed to that the below-identified discloser of confidential information may provide certain information that is and must be kept confidential. To ensure the protection of such information and to preserve any confidentiality necessary, it is agreed that:
The Recipient shall limit disclosure of Confidential Information within its own organisation to its directors, officers, partners, members, employees and/or independent contractors (collectively referred to as “affiliates”) having a need to know.
The Recipient and affiliates will not disclose the confidential information obtained from the discloser unless required to do so by law.
This Agreement imposes no obligation upon the Recipient with respect to any Confidential Information that was in the Recipient’s possession before receipt from the Discloser if the Confidential Information:
Is or becomes a matter of public knowledge through no fault of the Recipient;
Is rightfully received by Recipient from a third party not owing a duty of confidentiality to the discloser;
Is disclosed without a duty of confidentiality to a third party by, or with the authorisation of, Discloser; or
Is independently derived by Recipient.
This agreement states the entire agreement between the parties concerning the disclosure of Confidential Information. Any addition or modification to this Agreement must be made in writing and signed by the parties.
If any of the provisions of this Agreement are found to be unenforceable, the remainder shall be enforced as fully as possible, and the unenforceable provision(s) shall be deemed modified to the limited extent required to permit enforcement of the Agreement as a whole.

Payments:
All payments are non-refundable after 48 hours before the initial consultation have passed.
A 50% fee is deductible if the package is cancelled within 7 days. Outside of this if an assessment the usual cancellation terms apply.
Entire Agreement:
The terms of this Agreement constitute the entire agreement between Perfectly Polite Dachshunds and You and supersede any prior or contemporaneous written, oral, or implied agreement related to the Programme. If any portion of this Agreement is unenforceable, such portion shall be severed and the remainder of this Agreement shall fully enforceable.

Governing Law:
The construction, interpretation, and application of the terms of this Agreement are governed by the laws of England and Wales without regard to its conflict of law rules.
Privacy Notice:
Perfectly Polite Dachshunds collects and processes information about you when you engage us for services. This is essential for us to carry out the service effectively and fulfil our regulatory obligations. We use personal information collected for internal record keeping, completion of correspondence with you and implementation of services. The choice of how much information you provide is always in your control, however, certain information may be required in order for us to provide a service. We will not distribute your personal information to third parties other than referring veterinarians unless we have your permission to do so or are required to by law or regulation.
If you believe that any information of yours in our possession is incorrect, or if you wish to cease corresponding with us or for us to remove you information from our system, please contact us and we will take the necessary steps subject to legal regulation – within 28 days of receipt.
